ARTICLE F. ENCROACHMENT OFFICER

There is hereby created the position of encroachment officer to perform, monitor and enforce, with the help of deputies and under the supervision of the public works director, those activities carried on within public ways in the city, including, but not limited to, the issuance of encroachment permits and the inspection of public ways within the city. The encroachment officer shall carry out, enforce and perform all duties, provisions and mandates contained in the ordinances of the city concerning encroachment into city streets, drainage and utility corridors, and shall approve plans, specifications, and signing before encroachment permits are issued. In addition, the city encroachment officer and deputies are hereby specifically charged with enforcement of such ordinances and are granted express authority to issue citations in the name of the city for a violation of any city ordinances pertaining to matters under their jurisdiction. In addition to, or as an alternative to, issuance of such citation, the encroachment officer or deputies may report any violations of city ordinances of which they become aware to the public works director or city attorney for appropriate enforcement.
