For the purpose of this article, the following words shall have the meaning as herein defined:

ANTIQUE DEALER: A person engaging in the business or purchasing, bartering, exchanging or selling of old or archaic items representative of an older culture, excluding numismatic items and precious metals/gems. Any licensee who received antique items that contain precious metals/gems must also obtain a secondhand metal/gem dealer’s license.

NUMISMATIC DEALER: Any person engaging in the business of purchasing, bartering, exchanging or selling for a value, other than its face value, any coins or any currency of the world which, in its original form, was minted or manufactured for the purpose or use as legal tender in the nation or country of origin, including those coins and currency which are or were minted or manufactured for commemorative purposes, providing the commemorative coins were made for use as legal tender in the nation or country of origin, but shall exclude gold or silver marketed as commodity items.

PAWNBROKER: Any person who loans money on deposit of personal property, or deals in the purchase, exchange or possession of personal property on condition of selling the same back again to the pledger or depositor, or who loans or advances money on personal property by taking such property into his or her possession as security, and who sells the unredeemed pledges together with such new merchandise as will facilitate the sale of same.

SECONDHAND DEALER: Any person engaging in the business of purchasing, bartering, exchanging or selling any secondhand merchandise for value, but it shall not include any person who:

A. Deals solely in the purchasing, bartering, exchanging or selling of used motor vehicles or trailers;

B. Is required to be licensed under article H of this chapter, or is a recycler of waste containers, paper, glass, etc.;

C. Is a charitable organization operating a store, office or place of business which acquires secondhand goods or merchandise exclusively by donation;

D. Engages in the business of selling antiques, coins or currency, or secondhand precious metals/gems; or

E. Is a person who deals solely in the sale of used clothing, furniture or household goods that do not include electrical appliances/apparatus, jewelry, furs, original paintings or silverware.

SECONDHAND PRECIOUS METALS/GEM DEALER: Any person engaging in the business of purchasing, bartering, exchanging or selling, in any form, secondhand gold, silver, platinum or other precious metals, secondhand gems or any secondhand articles containing any precious gems. (Ord. 4-3-1998, 4-16-1998)
