All licensees to whom this article applies shall be subject to the following conditions: (Ord. 4-3-1998, 4-16-1998)

A. Records Required: It shall be unlawful for any person licensed by this article to fail to keep upon the licensed premises a record in which shall be entered at the time of receiving any item or goods, including those on consignment and including coins and currency (if obtained at a price other than face value), an accurate description of the article received, including serial numbers or other identifying marks if available, the amount of any money paid or value of property traded, the date of receiving such items, the name, address and description of the person making the transaction, and a numerical identifier obtained from identification containing a photograph of the person making the transaction. The person presenting the identification must be the same person whose photograph appears upon the identification. The date of sale, disposal or scrapping of the item shall be added when the item is sold, scrapped or otherwise disposed of. (Ord. 4-3-1998, 4-16-1998; amd. 2003 Code)

B. Ticket Required: Each licensee receiving an article or goods in the course of any business licensed hereunder shall also make out a serially numbered three (3) part ticket, one part to be retained by the licensee, one part to be retained by the pledger/seller, and one part containing the information required by this article, together with a legible fingerprint of the person making the transaction, preferably the right thumb print. The ticket shall bear a legible signature of the person making the transaction together with the person receiving the item on behalf of the licensee. If a general ticket is used it shall be adapted in each instance to show whether it receipts delivery of pawn or specific type of secondhand goods. A dealer licensed for one (1) category of goods hereunder is not automatically licensed to deal with goods of another named category.

C. Dealing With Specific Persons; False Information; Liability: It shall be unlawful for any licensee to receive items from a person who is under eighteen (18) years of age, or who is either intoxicated or obviously mentally deficient. It shall be unlawful for any person to willfully give the licensee (agents or employees) false or misleading information which the licensee is required by this article to obtain from such person. A licensee under this article is strictly liable for any and all acts of his or her own employees for any violation by them of any provisions of this article.

D. Bond Required: Unless lowered by the license officer based upon considerations unique to a particular licensee which would tend to minimize public health, safety and welfare concerns, the bond required by section 3-1-14 of this title in the case of any license issued or received after the passage of this article shall be in an amount no less than five thousand dollars ($5,000.00), conditioned upon the faithful performance by the licensee of all requirements of this article.

E. Retention: No article or goods taken in by a licensee hereunder shall be disposed of or altered within a period of thirty (30) days from the date of receiving such items, unless expressly permitted to do so by the police department prior to the expiration of the thirty (30) day period. Such items shall be available for inspection by any police officer during reasonable business hours while in the licensee’s possession or control. Upon reasonable request by a police officer, any item received by the licensee must be retained and held until released by the police department or placed in the custody of that department to be held as evidence. These retention provisions shall not apply to pawn items redeemed by the person identified on the pawn records as the original pledger or depositor thereof. (Ord. 4-3-1998, 4-16-1998)

F. Hours Of Business: No licensee hereunder shall keep his or her place of business open before the hour of seven o’clock (7:00) A.M. or after seven o’clock (7:00) P.M. of any day or on Sunday; provided, however, that on Saturday of each week and on days other than Sundays preceding legal holidays, and the last fifteen (15) days of December other than Sundays of each year, it shall be lawful for a licensee to keep his or her place of business open until eleven o’clock (11:00) P.M.
