ARTICLE K. MASSAGE ESTABLISHMENTS

The following words and phrases used in this article shall have the following meaning unless a different meaning clearly appears from the context:

MASSAGE: The practice whereby a person, either by the hands or with a mechanical or electrical apparatus, administers to another person effleurage (stroking), friction (rubbing), petrissage (kneading), tapotement (percussion) and vibration (shaking or trembling), or variations of these, and the use of rehabilitative procedures involving the muscles by nonintrusive means and without spinal manipulation. The practice of “massage” may include the use of oil rubs, heat lamps, salt glows, hot and cold packs, or tub, shower, steam or cabinet baths.

MASSAGE APPRENTICE: A person who is licensed as a massage apprentice by the state of Utah.

MASSAGE ESTABLISHMENTS: Any place where massages are given for hire.

MASSAGE TECHNICIAN: A person who is licensed as a massage technician by the state of Utah.

SEXUAL ACTIVITY: The massaging, touching or applying of any instrument or device by a licensee in the course of practicing or engaging in massage therapy to:

A. The genitals or anus; or

B. Breasts of a female patron, except when a female patron requests breast massage, as may be further defined by the state of Utah, division of occupational and professional licensing rule, and signs a written consent form, which must also include the signature of a parent or legal guardian if the person is a minor, authorizing the procedure and outlining the reason for it before the procedure is performed.
