A. Specified: No off-premises beer retailer licensee’s premises may be established within two hundred feet (200') of any community location, as measured from the nearest entrance of the licensee’s premises or establishment by following the shortest route of either ordinary pedestrian traffic or, where applicable, vehicular travel along public thoroughfares, whichever is the closer, to the property boundary of the community location.

B. Variance: Notwithstanding the foregoing, if the city council finds after full investigation that compliance with the proximity limitations set forth in subsection A of this section would result in peculiar and exceptional practical difficulties or exceptional and undue hardships, and after giving full consideration to the attending circumstances, following a public hearing, the city council may authorize a variance from the proximity limitation so as to relieve the peculiar and exceptional practical difficulties, or the exceptional or undue hardships, provided the variance may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of this chapter.
