A. The city council hereby adopts by reference and incorporates into this code all sections of Utah Code Annotated title 32B, Alcoholic Beverage Control Act, or successor provisions as amended, that relate to Class B misdemeanors, Class C misdemeanors or infractions. In the event the city code is inconsistent with the requirements of the Act, the city code shall control, except if the state law preempts the city code then the state law shall control.

B. It is unlawful:

1. For a person to buy for resale, sell or deal in alcoholic product without complying with the provisions of this chapter, the Act and any other applicable law;

2. For an off-premises beer retailer licensee or its employee to sell, dispose of, deliver or give beer to any person between the hours of one o’clock (1:00) A.M. and seven o’clock (7:00) A.M.;

3. For an on-premises beer retailer/non-tavern recreational amenity retailer to serve beer in containers other than a clear glass, a clear pitcher or the beer’s original container; or

4. For an on-premises beer retailer/non-tavern recreational amenity retailer to serve alcohol or allow anyone to consume alcohol in any room that is not clearly visible to the recreation area and is not open for use by patrons including minors.
