As used in this chapter, the following words and terms shall have the meanings ascribed to them in this section:

TELEMARKETING BUSINESS: Any sales operation whereby telephone solicitation or attempted telephone solicitation is initiated with the prospective purchaser, either directly or by mailed request that the prospective purchaser call the solicitor, in an effort to encourage the individual to purchase or rent any goods, wares, services or merchandise and to pay any consideration whatsoever for the same, where the solicitor, as an inducement to purchase will receive a premium, gift, certificate or other paper giving the purchaser the right, chance or privilege to purchase or receive goods, wares, services or merchandise, whether for a fee or without cost, for purchases made. It shall also include any operation in which the telephone solicitor attempts to encourage an individual to accept premiums, merchandise or service (“free” or otherwise) that requires a shipping or handling fee or any other attendant fee to be paid before shipment.

TELEMARKETING FACTOR: Any person or organization that buys or takes consignment of sales orders or premiums as described in the definition of “telemarketing business”, as defined in this section, from a seller, solicitor or his agent for the purpose of completing performance of those orders.

TELEPHONE SOLICITOR: Any person who, by telephone, performs any of the tasks listed in the definition of “telemarketing business”, as defined in this section. (Ord. 7-1-1988, 7-7-1988; amd. Ord. 4-1-1989, 4-6-1989; 2003 Code)
