3-8-3: ZONE PERMITTED; DISTANCE RESTRICTIONS; CLASSIFICATION:
A. Zone Permitted; Distance Restrictions; Measurement: The establishment of a sexually oriented business shall be permitted only in M-1 manufacturing zone and shall be subject to the following restrictions:
1. No person shall cause or permit the establishment of any of the following “sexually oriented businesses” as defined in section 3-8-2 of this chapter: a) within one thousand feet (1,000') of another such business; or b) within one thousand feet (1,000') of any religious institution, school, boys club, girls club, or similar existing youth organization, or public park, public square or public building; or c) within one thousand feet (1,000') of any property zoned as a residential district, where zoning allows (except with regard to caretaker residences in a commercial or manufacturing zone), any residential use or any properties actually used for residential purposes.
2. As regarding subsection A1 of this section, distance between two (2) sexually oriented businesses shall be measured in a straight line, without regard to intervening structures, from the closest property line of each business. The distance between any sexually oriented business and any religious institution, school, boys club, girls club, or similar existing youth organization, public park, public square, public building, or any properties zoned as a residential district, zoned to allow residential use or used for residential purposes, shall also be measured in a straight line, without regard to intervening structures or objects from the nearest property line of the premises where the sexually oriented business is conducted to the nearest property line of the premises of a religious institution, school, boys club, girls club, or similar existing youth organization, public park, public square, public building, or any properties zoned as a residential district, zoned to allow any residential use, or used for residential purpose. B. Classification: The classification of businesses regulated are:
1. Adult arcade;
2. Adult bookstore, adult novelty store or adult video store;
3. Adult cabaret;
4. Adult motel;
5. Adult motion picture theater;
6. Adult theater;
7. Massage parlor;
8. Sexual encounter establishment;
9. Escort agency; or
