For purposes of this chapter, the following terms shall have the following meanings:

BIWEEKLY: Every other week.

COMMERCIAL: Any premises or property:

A. Used primarily in connection with the supply of goods or services on a regular basis or in the regular course of business;

B. Used for apartment complexes with more than eight (8) dwelling units;

C. Condominium or townhome complexes used primarily, when considered as a whole, for rental purposes as determined by the district;

D. RV parks used primarily for overnight or other rental of less than thirty (30) consecutive days; or

E. Used for motels or hotels.

COMMERCIAL HAULER: Any person or entity who is engaged primarily in the business of collecting and disposing of commercial solid waste generated by any other person or entity.

COMMERCIAL SOLID WASTE: Any solid waste produced by or resulting from the use of commercial property or premises.

CURBSIDE: A location within three feet (3') of any curb, sidewalk or other location immediately adjacent to any street, highway or road which is accessible to waste collection vehicles.

DISTRICT: Washington County special service district 1.

DUMPSTER: Any container constructed of metal, of two (2) yards’ volume or more, and designed to be compatible with mechanical collection equipment.

HAZARDOUS WASTE: Shall have the same meaning as specified in Utah Code Annotated section 19-6-102(10), as amended.

PRIVATE HAULER:

A. Any person or entity who, as the owner, tenant or other occupant of property or premises classified as commercial, collects and disposes of solid waste generated by the use of said property; and

B. Any person or entity who collects and disposes of construction debris.

RESIDENCE:

A. Any property or premises containing a building or structure which is used for human habitation, or which is hooked to culinary water and power and intended for human habitation, but excluding:

1. Apartment complexes with more than eight (8) dwelling units;

2. Condominium or townhome complexes used primarily, when considered as a whole, for rental purposes as determined by the district;

3. RV parks used primarily for overnight or other temporary rental of less than thirty (30) consecutive days;

4. Condominium or townhome developments approved to utilize dumpsters as a means of solid waste collection as of October 27, 1999, as set forth in section 4-4-6;

5. Dwelling units in residential developments which, because of limited access, receive weekly collection of residential waste using dumpsters instead of residential solid waste or residential recycling containers; and

6. Motels or hotels.

B. Each unit of a building or structure on property or premises classified as residential shall be considered as a separate residence for purpose of billing and collection.

RESIDENTIAL RECYCLABLE MATERIALS: Those materials identified by the district as recyclable but specifically excluding glass, plastic bags, used oil, paint, hazardous waste, bulky waste, special waste and stable matter.

RESIDENTIAL RECYCLING CONTAINER: A waste receptacle specifically approved by the district for the automated curbside collection of residential recycling materials.

RESIDENTIAL SOLID WASTE: Any solid waste produced by or resulting from the use of any residential property or premises, except for hazardous waste and construction/demolition waste.

RESIDENTIAL SOLID WASTE CONTAINER: A waste receptacle specifically approved by the district for the automated curbside collection of residential solid waste.

RESPONSIBLE PARTY: A utility customer that has, as of October 31, 2015, an existing residential application for utility services on file with the city and a utility account in their name or the name of their spouse.

SOLID WASTE: Shall have the same meaning as specified in Utah Code Annotated section 19-6-502(10), as amended.

UTILITY CUSTOMER: Those customers who receive residential water and/or power services from the city. (Ord. 2020-04-006 § 2, 4-16-2020)
