A. A utility customer of a residence which has utility services as of October 31, 2015, and opted out of the curbside residential recycling collection program prior to April 1, 2020, may continue to opt out so long as the responsible party resides in the city or until:

1. A responsible party on the account requests in writing that the election to opt out of curbside residential recycling collection service be canceled or rescinded; or

2. The responsible party no longer resides in the city and is no longer a utility customer of the city; or

3. The curbside residential recycling collection program is terminated by the city council.

B. Notwithstanding the provisions of subsection A of this section, a responsible party may file a written request with the city administrative services director or the designee asking to opt out of the recycling program based on a showing of undue hardship or other extraordinary circumstances. The responsible party shall include in their request a statement outlining the hardship or extraordinary circumstances. The city shall receive written evidence, review the evidence, and determine if undue hardship or other extraordinary circumstances exist to justify allowing the responsible party to opt out of the curbside residential recycling program.
