4-8-2: PROHIBITION OF OLEANDER PLANTS:
A. The oleander plant is prohibited within the city in the following zones:
1. Agricultural zones as defined in title 10, chapter 5 of this code.
2. Mining and grazing zones as defined in title 10, chapter 6 of this code.
3. Residential estate zones as defined in title 10, chapter 7, article A of this code.
4. Open space zones as defined in title 10, chapter 12 of this code.
B. No person, partnership, corporation, public agency, or similar organization shall plant, cultivate, or maintain the oleander plant at any place in the prohibited zones for any purpose. Every oleander plant shall be removed from the prohibited zones within thirty (30) days of the enactment of this chapter.
C. A violation of this section is an infraction and, upon conviction, subject to penalty as provided in section 1-4-1 of this code.. (Ord. 2006-09-001, 9-7-2006)
