A. Appointment; Removal: The mayor shall, subject to the advice and consent of the city council, appoint a person to act as chief of police. The chief of police may be removed from office by the mayor as otherwise provided by law.

B. Powers And Duties:

1. The chief of police shall direct the police work of the city, be responsible for the enforcement and maintenance of law and order, and ensure that each necessary function of police service required by law or directed by the city council and mayor is carried out.

2. With the advice and consent of the mayor, the chief of police may appoint assistant police chiefs or other command level officers to perform such duties as may be delegated to them by the chief of police.

3. The chief of police may assign any subordinate officer or employee in the department to any duty which in his or her judgment the good of the service may require, and may change such assignment from time to time whenever in his or her judgment the good of the service requires.

4. The chief of police shall make and adopt rules and regulations for the operation of the department. Such rules and regulations shall be approved by the mayor, with the advice of the city manager, and shall be binding on all members and employees of the department. Such rules and regulations may cover the conduct of the members and employees of the department, uniforms and equipment to be worn or carried, assignments, hours of service and all other similar matters necessary or desirable for the better efficiency of the department.

5. The chief of police shall consult and advise with the mayor, and act with the mayor’s approval on all matters pertaining to the police department not herein specifically provided for, and shall from time to time make such reports as the mayor shall require and shall annually report to the city council on the state of affairs and conditions of the police department.

6. It shall be the duty of the chief of police to keep all lost, stolen or evidentiary property that comes into the possession of the police department or any of its members, and all reasonable efforts shall be made to discover the owners and restore the property to the owners. The chief of police shall be obligated to comply with the requirements of Utah Code Annotated sections 77-24-1 through 77-24-5 concerning the disposal of property received by peace officers. The preceding provision shall not prohibit the chief of police from disposing of firearms as provided for by Utah Code Annotated section 76-10-525. (Ord. 2002-01-008, 1-17-2002)
