A. Definitions: As used in this section, the following words and terms shall have the meanings ascribed to them in this section:

MASS GATHERING: An outdoor assembly of one hundred (100) or more people on city owned property that reasonably can be expected to continue for two (2) or more hours.

PUBLIC PARK: Public land which has been designated for park or recreational activities, including, but not limited to, a park, playground, nature trail, swimming pool, reservoir, athletic field, basketball or tennis court, pedestrian or bicycle path, open space, wilderness area, or similar public land within the city which is under the control, operation, or management of the city. Public park does not include a public square.

PUBLIC SQUARE: Property owned and maintained by the city that has been designated as a public square and is open for public use as provided in this chapter.

SMOKE OR SMOKING: Possession, carrying, or holding a lighted pipe, cigar, electronic cigarette, or cigarette of any kind, or any other lighted smoking equipment, or the lighting or emitting or exhaling of smoke of a pipe, cigar, electronic cigarette, or cigarette of any kind, or of any other lighted smoking equipment.

B. Smoking Prohibited In Public Parks, Cemeteries And Near Mass Gatherings:

1. Prohibitions: Smoking is hereby prohibited in public parks, public squares, city owned cemeteries, within twenty-five feet (25') of bus stops, and within fifty feet (50') of mass gatherings.

2. Posting Of Signs: “No smoking” signs or the international “no smoking” symbol (consisting of a pictorial representation of a burning cigarette enclosed in a red circle with a red bar across it) shall be clearly and conspicuously posted in every public park and public square.

C. Penalty: A violation of this section is an infraction and, upon conviction, a person is subject to penalty as provided in section 1-4-1. Each violation shall be a separate offense. (Ord. 2017-04-002, 4-6-2017)
