The city shall not be liable for any loss, injury or damage resulting from the interruption, restoration or reduction of electrical services from any cause which could not have been avoided by the exercise of reasonable and prudent utility practices, including, but not limited to, failure of generation and distribution systems, inadequacy of energy supply, implementation of emergency plans, temporary disconnections for repairs and maintenance or failure to pay for service rendered. The city shall have liability for outages or stoppages resulting from gross negligence or willful misconduct in its operation of the electrical system. During an emergency declared by an appropriate authority, the city may curtail electric service. (Ord. 2-2-1993, 3-1-1993)
