A. It shall be unlawful for any person, either directly or indirectly, to commence, conduct or carry on any business, including a nonprofit enterprise, in a residential zone except as specifically allowed in this chapter.

B. Two (2) categories of home occupations are permitted in a residential zone:

1. Class A Home Occupation: Class A home occupations are permitted to operate in a residential zone without a business license as provided in this chapter. If the owner of a Class A home occupation requests a business license from the city, the application shall be treated as a Class B home occupation license and Class B fees shall apply. The owner of a Class A home occupation that chooses to obtain a business license is not required to renew the license.

2. Class B Home Occupation: It shall be unlawful for any person, either directly or indirectly, to commence, conduct or carry on any Class B home occupation without first procuring a home occupation business license from the city.

C. Each license shall authorize the person obtaining it to carry on, pursue or conduct only that type of general business described in the license and only at the location which is indicated thereon. The carrying on of a different type of general business activity shall require issuance of a separate license, and carrying on of the business at a location different from that indicated on the license shall be considered a branch establishment and require a separate license.

D. A person engaged in two (2) or more businesses at the same location shall be required to obtain separate licenses for each business, but, in the discretion of the license officer, when such businesses are complementary, a single license may be issued which shall specify on its face all such businesses operated at that location.

E. A violation of this section is a Class B misdemeanor and shall be prosecuted under section 3-1-21 of this title. (Ord. 2018-02-008, 2-1-2018)
