A. It is unlawful for a person who owns, possesses, controls, or is in charge of property to permit occupancy of any building, structure, or part thereof for living, sleeping, cooking, or eating:

1. If the building, structure, or part thereof, was not intended to be used for such occupancy; or

2. If the building, structure, or part thereof is unfit for use. A dwelling is unfit if it does not have hot and cold potable running water for every kitchen sink, bathroom lavatory, bathtub, and shower; does not have an operational toilet and plumbing; or does not have the ability to heat and cool the dwelling as required by the Uniform Building Code.

B. It is unlawful for a person who owns, possesses, controls, or is in charge of property to occupy a dwelling or dwelling unit that does not have all utility services connected and operating.

C. It is unlawful for a person who owns, possesses, controls, or is in charge of property to fail to maintain all parts of the premises in a clean and sanitary condition. This includes the proper disposal of garbage, refuse, and fecal matter. (Ord. 2020-02-006 § 2 (Att.), 2-6-2020)
