The city shall have the right to cause removal of any dead or diseased tree on private property within the city, when such tree constitutes a hazard to life and property, or harbors insects or diseases that constitute a potential threat to other trees. The city forester will notify in writing the owners of such trees. Removal shall be done by said owners at their own expense within sixty (60) days after the date of service of notice. In the event of failure of owners to comply with such provisions, the city shall have the authority to enter upon said property to remove a hazardous tree and charge the cost of such removal to the owner. Prior to removal of a hazardous tree by the city, notice shall be given the property owner in the manner provided in subsection 7-4-3B of this chapter. (Ord. 2017-06-011, 6-15-2017)
