A. The purpose of this chapter is to (1) regulate the use of public rights-of-way by wireless communication providers related to small wireless communication facilities to the extent allowed by law to promote and protect public health, safety, and welfare, (2) provide for an application process to allow wireless communication providers to obtain a permit to deploy small wireless facilities in public rights-of-way to control the public rights-of-way, (3) define reasonable and nondiscriminatory design standards for small wireless facilities to promote consistency of design, and (4) set fees for the actions authorized hereunder to compensate the city for the use of, and the use of its resources to manage, the public rights-of-way.

B. This chapter applies only to small wireless facilities located in public rights-of-way. This chapter does not apply in any manner to (1) wireless communication facilities that are not small wireless facilities, (2) uses of public rights-of-way that are not related to small wireless facilities, or (3) the activities of wireless communication providers on any land that is not a public right-of-way.
