A. Initial Appeal: Any applicant for a special event permit desiring to appeal an administrative decision concerning the denial, condition or modification of a special event permit may appeal to the administrative law judge (ALJ) within five (5) calendar days of the written decision. All appeals to the ALJ shall be in writing, shall state the specific grounds for the appeal, and shall be delivered to the city recorder via email or by hand delivery. Any decision made by the ALJ shall be considered the final decision of the city.

B. Court Appeal: An applicant may appeal the ALJ’s decision by seeking judicial review with the district court within thirty (30) calendar days of the ALJ decision. The court’s review shall be limited to a review of the record. The district court shall presume the ALJ’s decision is valid and shall review the record to determine whether or not the decision was arbitrary, capricious, or illegal. (Ord. 2023-017, 8-31-2023)
