A. The city council shall review the environmental mitigation fee assessed herein in January of every fifth year, starting in 2025. The review is to determine whether or not the environmental mitigation fee is still required to administer and implement the habitat conservation plan, and if the city council determines the environmental mitigation fee is still necessary to administer the habitat conservation plan. Unless reauthorized prior to expiration, the environmental mitigation fee imposed herein shall expire in 2030. Any reauthorization shall be for a five (5) year period.

B. The city council may rely on studies and reports provided by and produced for Washington County when making the environmental mitigation fee determination as required herein. (Ord. 2024-017, 3-7-2024)
