In the event of market-driven pricing and ordering constraints which require immediate or quick turnaround for procurement of supplies or materials, the affected department head may proceed with the acquisition at the lowest attainable price without further compliance with the procedures provided herein. In such event, however, the department head shall file with the city manager a full report of the circumstances of the acquisition. Upon written approval by the city manager, the procuring department will file the report with the purchasing manager. The need for the acquisition arises when, due to market conditions, the manufacturer or vendor provides a short timeline for purchase and there is insufficient time to follow standard purchasing procedures, including city council approval as applicable.

A “time-sensitive/market-driven” situation encompasses any fact, circumstance, or scenario wherein the abbreviated purchasing timeframe precludes adherence to standard purchasing protocols, including approval by the city council as applicable. (Ord. 2023-026, 10-19-2023)
