For the purpose of this chapter, the following terms, phrases, and words shall mean:

CITY: City of St. George, a municipal corporation of the state of Utah.

COUNCIL: City council of the city of St. George.

CUSTOMER OR PERSON: Any individual; public or private corporation and its officers; partnership; association; firm; trustee; executor of an estate; the state or its departments; institutions, bureaus, agencies; counties; city; political subdivision; or any other governmental or legal entity recognized by law.

DEVELOPED PARCEL: Any parcel whose surface has been altered by grading, filling or construction of any improvement.

DIRECTOR: The director of the department of public works or his designee.

DWELLING UNIT: One or more rooms in a dwelling, designed for or occupied by one family for living or sleeping purposes and having kitchen facilities for the use of not more than one family.

EQUIVALENT RESIDENTIAL UNIT (ERU): Three thousand (3,000) square feet of impervious surface area.

IMPERVIOUS SURFACE: A parcel’s hard surface area that causes water to run off its surface in greater quantities or faster than natural conditions. Some examples of impervious surfaces are rooftops, concrete or asphalt paving, walkways, patios, driveways, parking lots or storage areas.

MITIGATION: Stormwater control facilities located on a parcel, which either hold runoff for a short period of time before releasing it to the storm water drainage system, or hold water until it evaporates or infiltrates into the ground.

NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) STORM WATER REGULATIONS: The provisions of the federal Clean Water Act for the control of stormwater discharges.

PARCEL: The smallest, separately segregated unit of land having an owner. A parcel has boundaries and surface area, and is documented with a property number by Washington County (“county”).

RESIDENTIAL PARCEL: Any parcel of land paying a residential electrical rate, or in the case of those who do not receive electricity from the city system, any parcel of land which is billed the residential rate for either garbage collection or sewer fees.

STORMWATER: Water produced by storm, surface drainage, snow and ice melt, spring flows, groundwater and other water handled by the stormwater drainage system.

STORMWATER DRAINAGE FEE OR FEE: The fee created by this chapter, which generates revenue to operate, maintain, regulate and improve stormwater facilities and programs within St. George City.

STORM WATER DRAINAGE SYSTEM: All manmade storm water facilities and conveyances, and natural storm water drainage within the city’s limits that store, control, treat and/or convey storm water.

UNDEVELOPED PARCEL: Any parcel that has not been altered by grading, filling or construction. (Ord. 2003-05-001, 5-1-2003; amd. Ord. 2023-041, 12-7-2023)
